Democrat Congresswoman Seeks To Replace ‘Husband, Wife’ With ‘Spouse’ In Federal Laws

The words “husband” and “wife” are now used in federal law; new legislation introduced by California’s Democratic Representative Julia Brownley would replace them with a number of other names, including “spouse.

Brownley introduced the “Amend the Code for Marriage Equality Act,” which aims to change various current statutes by removing the words “husband” and “wife” from their language.

Depending on the context, the proposed legislation would replace the words with wording like “a married couple,” “married person,” and “person who has been but is no longer married to.

“Despite the U.S., There are numerous occasions where the United States Supreme Court has held that same-sex couples have the right to marry, including Obergefell v. Hodges.

The Code disregards that constitutional protection, according to Brownley, who issued a statement.

“Congress must demonstrate its commitment to supporting equality now more than ever, with an extreme Supreme Court and state legislatures rolling back the rights of the LGBTQ community,” she concluded.

By acknowledging and implementing the idea that the words in our laws have meaning and that our beliefs as a nation are reflected in them, this commonsense initiative would make sure that our federal code represents the equality of all marriages.

The bill has already been presented to Congress. Rep. Lois Capps, a California Democrat who is now retired, first proposed the idea in 2015. Ms. Brownley continued her initiative in 2021, 2019, and 2017, and in those years, the bill was introduced three more times.
